PLEASE READ THE FOLLOWING TERMS AND CONDITIONS
OF USE CAREFULLY BEFORE USING THIS WEBSITE. All users of this site agree that
access to and use of this site are subject to the following terms and conditions
and other applicable law. If you do not agree to these terms and conditions,
please do not use this site.
Our 100% GUARANTY that our items will ship out
Brand New in Box with some to no assembly required.
NOTE: ALL SALES ARE FINAL.
Please make your selection with care and be sure that you buy exactly what you
want before your make your final purchase at checkout. Due to the nature of
Chinese airsoft products, we cannot vouch for their reliability therefore we
have a very limited warranty on these models.
Limited Warranty:
We will allot
a time frame of 3 days for you to inspect your item for mechanical defects
(blemishes are not covered nor are accessories such as lasers, batteries, and
chargers.) Within that time frame of receipt, we must receive email confirmation
that your item is defective with a detailed account of what is wrong and how was
the item last used before the defect occurred. A defect is defined by a
mechanical flaw, usually internal, that was made evident upon the first use of
the item. Any breakage that occurs during normal use is not considered a defect
and is not covered by our limited warranty.
Returns for Exchange Only:
We will issue
an exchange if your item is received defective or the incorrect item was
shipped. If we do not have the correct part in stock we will credit you back the
amount of the part not including any shipping fees. No returns will be accepted
after 3 days of the item received. Buyer must abide in the conditions below:
- Buyer is responsible for return shipping
costs and insurance.
- Shipping and handling fee are non
refundable.
- Goods must also be in its original box and
packing when returning.
- Upon reviewing the
condition of the defective item, we'll immediately replace your item.
By buying our items,
you must understand and abide to the following restrictions:
Age: I am at
least 18 years of age and do not know of any local or state laws that would
prohibit me from purchasing or owning 6mm plastic bb air soft toy gun products,
and or firearm imitation/replica toys.
Exempt
States/Countries: By purchasing you understand that it is buyers responsibility
to investigate state, and local laws which may prohibit the use, or possession
of airsoft guns. We do not ship to Canada or overseas. No Exceptions.
Safety
Markings: Airsoft guns are required by Federal Law to have the tip (1/4 inch) of
the barrel permanently colored in blaze orange.
Safety
Measures: I understand this is classified as a toy, yet because of its ability
to emit projectiles it may cause harm to animals, and or humans. I agree that
this toy gun will not be used to shoot animals, nor humans. Agree to wear proper
protection when in use.
Federal Law: I
understand that Federal Law states that the use of any look-alike, replica or
toy gun in a crime carries the full ramifications as a real firearm. DO NOT
BRANDISH ANY AIRSOFT GUN IN PUBLIC.
Payments accepted: Google Checkout, Paypal (All Major Credit Cards Through
Paypal), Cashiers Check and Money Orders.
Shipping: Shipping charges cover
postage and packaging. By purchasing you agree to these charges. Orders are
shipped within 1-3 business days of payment, unless a problem arises (Most are
shipped next day). Please only contact us about the status of an order if you
believe there may be a problem, or if it has been 7 business days since we
received payment, and you have not received your order.
Return Authorizations:
If you encounter a problem with an order please contact us within 24 hours so we
may do our best to correct the problem. If an item must be returned, the buyer
will be responsible for those shipping expenses unless otherwise stated. You
must request a return authorization number, “RMA” in order to return ANY item.
All items to be returned MUST have an “RMA” number. Print this number on the
outside of the box. The item must be received within 7 days of the return
request. Please include a note with the item explaining the problem, give your
name, address, auction number, E-mail address, RMA number and whether you've
requested a refund or an exchange. Things that void a warranty are physical
abuse of the item, improper use, not returned with all the pieces/parts, any
permanent alterations, and swearing/threatening customer service. Items returned
in perfect working order, will be charged a 15% restocking fee on the bid price.

Monster Airsoft USA does not represent or warrant that the functions contained in the site will be uninterrupted or error-free, that the defects will be corrected, or that this site or the server that makes the site available are free of viruses or other harmful components. Monster Airsoft USA does not make any warrantees or representations regarding the use of the materials in this site in terms of their correctness, accuracy, adequacy, usefulness, timeliness, reliability or otherwise. Some states do not permit limitations or exclusions on warranties, so the above limitations may not apply to you.
Limitation of Liability
Monster Airsoft USA shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the products, even if Monster Airsoft USA has been advised of the possibility of such damages. Applicable law may not allow the limitation of exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you.
Typographical Errors
In the event that a Monster Airsoft USA product is mistakenly listed at an incorrect price, Monster Airsoft USA reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. Monster Airsoft USA reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Monster Airsoft USA shall issue a credit to your credit card account in the amount of the incorrect price.
Term; Termination
These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by Monster Airsoft USA without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

Monster Airsoft USA may deliver notice to you by means of e-mail, a general notice on the site, or by other reliable method to the address you have provided to Monster Airsoft USA.
Miscellaneous
Your use of this site shall be governed in all respects by the laws of the state of Texas, U.S.A., without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of Monster Airsoft USA products) shall be in the state or federal courts located in Los Angeles County, California. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of Monster Airsoft USA products) must be commenced within one (1) year after the claim or cause of action arises. Monster Airsoft USA's failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. Monster Airsoft USA may assign its rights and duties under this Agreement to any party at any time without notice to you.
Use of Site
Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a Monster Airsoft USA or other licensed employee, host, or representative, as well as other members or visitors on the site is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law.
